Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Winsome Consulting LLC (“PublishFlow”, “we”, “us”, or “our”), a Delaware limited liability company, governing your use of the PublishFlow website, web application, and related services available at publishflow.io (the “Service”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 16 years old to use PublishFlow. If you are using the Service on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

2. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@publishflow.io if you suspect any unauthorized use of your account.

You agree to provide accurate, current, and complete information when creating your account, and to keep that information up to date.

3. The Service

PublishFlow is an AI-powered tool that helps you turn case studies, blog posts, and voice notes into LinkedIn-ready posts. We use third-party AI providers (currently Anthropic and OpenAI) to generate text and transcribe audio. The outputs are designed to assist your content creation but should be reviewed before publishing.

Features, plans, and pricing may change over time. We will give you reasonable notice of material changes that affect you.

4. Acceptable use

You agree NOT to use PublishFlow to:

  • Violate any applicable law or regulation
  • Infringe on the intellectual property rights of others
  • Generate, distribute, or publish content that is unlawful, defamatory, harassing, hateful, fraudulent, or sexually explicit
  • Impersonate any person or misrepresent your affiliation with anyone
  • Generate content intended to deceive, manipulate, or harm others
  • Attempt to reverse engineer, decompile, or extract the source code of the Service
  • Use bots, scrapers, or other automated tools to access the Service in ways that exceed normal use
  • Resell or sublicense the Service without our written permission
  • Interfere with the security or integrity of the Service

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

5. Your content

You own your content. Any source material you upload (case studies, blog posts, voice recordings, transcripts) and any LinkedIn posts we generate for you remain your intellectual property.

By using the Service, you grant us a limited, worldwide, non-exclusive license to process, store, and display your content solely for the purpose of providing the Service to you. We do not claim ownership of your content, and we do not use it to train AI models. You can delete your content at any time from your dashboard.

You are solely responsible for the content you upload and the posts you publish. You represent and warrant that you have the right to use any source material you upload, and that publishing the generated content does not violate any third party's rights.

6. AI-generated content

PublishFlow uses third-party AI models to generate text. AI outputs may sometimes be inaccurate, incomplete, or unsuitable. You are responsible for reviewing all generated content before publishing it. We make no warranty that the generated content will be factually accurate, free of errors, or fit for any particular purpose.

Generated content is provided to you on a non-exclusive basis. Identical or similar outputs may be generated for other users from similar inputs.

7. Subscriptions and payment

PublishFlow offers free and paid plans. Paid plans are billed in advance on a recurring basis (monthly or annually) through our payment processor, Stripe. By subscribing, you authorize us to charge the payment method on file for the applicable subscription fees.

Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods, except where required by law.

We may change our pricing from time to time. If we change the price of an existing subscription, we will give you at least 30 days' notice and you may cancel before the new price takes effect.

8. LinkedIn integration

If you connect your LinkedIn account to PublishFlow, you authorize us to publish posts on your behalf using LinkedIn's API. You are responsible for the content you choose to publish through PublishFlow and for complying with LinkedIn's own Terms of Service and Professional Community Policies. You can disconnect your LinkedIn account at any time, which immediately revokes our access.

9. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Winsome Consulting LLC and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, fail to pay applicable fees, or if we are required to do so by law.

On termination, your right to use the Service ends. We will delete your personal data in accordance with our Privacy Policy.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR YOUR PURPOSE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WINSOME CONSULTING LLC, ITS OFFICERS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.

13. Indemnification

You agree to indemnify and hold harmless Winsome Consulting LLC and its affiliates from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.

14. Governing law and dispute resolution

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through an in-app notice at least 14 days before the changes take effect. Your continued use of the Service after the changes become effective constitutes your acceptance of the updated Terms.
